Web site advertising agreement

1. Pricing

Fees may be paid monthly, by the 1/4, or annually. Fees are based on the content and/or linking methods. The prices for advertising are located at our online pricing guide, all prices are negotiable. You may click here to view. All advertisers will be referred to as CLIENT through-out the rest of this agreement.

2. Refund to CLIENT

After the commencement of an advertisement, that is, by the advertisement being available, accessible, or viewable to third-parties via the internet, there will be no refund of monies paid by the CLIENT to BusinessMT.com.

3. Advertisement Review

The CLIENT may submit a facsimile or other reproduction of the item or items the CLIENT desires to have advertised on BusinessMT.com. BusinessMT.com shall examine the facsimile or reproduction and reserves the right to either edit the advertisement for technical web based considerations or refuse to accept the advertisement for business policy concerns. All advertisements will be controlled by BusinessMT.com. Any changes that may be requested by CLIENT will be fee based and a charge of $40.00 an hour ( a one hour minimum applies) will be billed to CLIENT upon completion except with Basic Package listing, where unlimited updates are available at no charge

4. Linking of web site

All CLIENT links applied to advertisement from BusinessMT.com will be approved by BusinessMT.com before linking. CLIENT web site advertisement will include upto four (4), but not limited to, links to CLIENT business web site and email at the advertised price. All graphic images must be approved by BusinessMT.com before placement in web site advertisement. Graphic images may be substituted by BusinessMT.com for more compatible content. All logos applied to site that do not belong to BusinessMT.com will remain the possession of each individual CLIENT which submits it's own logo or graphic image. BusinessMT.com will not be responsible for providing logos applied to web site advertisement or the trademarks applied. The Logos provided by CLIENT must be copyright protected prior to placement on web site advertisement. Trademarks supplied by CLIENT must be registered and legally owned by CLIENT before providing to BusinessMT.com for placement on web site advertisement.

5. Limitation of Liability by BusinessMT.com

BusinessMT.com shall not be responsible to the CLIENT or liable to the CLIENT for any matters, disputes, or disagreements between the CLIENT and third-parties as a result of this AGREEMENT. BusinessMT.com limits its duty and obligation to the CLIENT to the extent BusinessMT.com has provided internet based web services to the CLIENT to solicit contacts from third-parties regarding CLIENT web site advertisement. To the extent that BusinessMT.com has fulfilled that obligation, BusinessMT.com makes no other representations regarding who contacts the CLIENT or the obligations derived from such contacts. The CLIENT acknowledges that BusinessMT.com has no control over who or what contacts the CLIENT as a result of the CLIENT using the internet to market the CLIENT product, service, or merchandise.

6. Results of Advertisement

While BusinessMT.com is committed to a high quality service and web based technology that is designed to have your web site advertisement reach the maximum audience, BusinessMT.com cannot guarantee that your product, service, or merchandise will sell or be greeted favorably by the internet viewing community or other third-parties.

7. Invalidity of Provisions

If any part of this AGREEMENT is unenforceable as determined by a court of law, the remaining parts of the contract shall remain in full force and effect.

8. Warranties, Amendments, and Modifications

BusinessMT.com and the CLIENT acknowledge that the whole of their agreement, including warranties, expressed or implied, is contained in this writing and this writing may be changed at any time without consent of the CLIENT. Notification to CLIENT is not required and will only be done if content of web site advertisement of individual CLIENT is changed or altered. In some cases a fee to alter or change content may be charged to CLIENT. This fee will be negotiated prior to any changes requested by CLIENT are made. Any changes to web site advertisement needed per BusinessMT.com's requirements will be made without contacting CLIENT free of charge and may be required by web based advertisement content modifications. This is done solely at BusinessMT.com's discretion and BusinessMT.com will not be held responsible to any CLIENT or third party, for damages, disagreements, or other adverse activities that may arise from CLIENT use of web site advertising provided by BusinessMT.com. BusinessMT.com reserves the right to refuse service or discontinue service of web site advertising without notice to any one CLIENT at any time and under any circumstances.

9. Notice

Any notice permitted or required under this AGREEMENT shall be in writing and shall be deemed given when delivered personally or three days after being sent by first-class mail to the party for which it was intended at the address stated at the beginning of this agreement or at an address specifically requested by the CLIENT or BusinessMT.com in a separate writing.

10. Law Governing Contract

This AGREEMENT shall be governed by the laws of the Commonwealth of Montana.

11. Reserves

BusinessMT.com reserves the right to remove, replace or decide the correct classification of "Advertisements" and their legal standing.
